Lindsay Lohan has pled no contest to misdemeanor charges, and will serve 1 day in jail.
Today, Lindsay Lohan pled "no contest" to the following charges – in total, 7 misdemeanor charges were laid for the two separate arrests:
- cocaine possession (misdemeanor drug possession)
- driving with a blood alcohol level over the limit of .08 percent
- being under the influence of cocaine
- reckless driving
A no contest plea is neither an admission of guilt, nor a denial. Two counts of driving under the influence were dropped in the plea agreement.
Lindsay Lohan was not charged with any felony charges. Although Lindsay possessed cocaine on both arrests, the amounts were below the .05 grams required for felony charges. The DA considered Lindsay Lohan to be struggling under her addiction – hence the two very close arrests – but her immediate check-ins to rehab helped as well. Lindsay Lohan’s unstable family condition was a factor as well.
Lindsay made this statement to the judge, and later sent it to TMZ:
"It is clear to me that my life has become completely unmanageable because I am addicted to alcohol and drugs. Recently, I relapsed and did things for which I am ashamed. I broke the law, and today I took responsibility by pleading guilty to the charges in my case. No matter what I said when I was under the influence on the day I was arrested, I am not blaming anyone else for my conduct other than myself. I thank God I did not injure others. I easily could have.
I very much want to be healthy and gain control of my life and career and have asked for medical help in doing so. I am taking these steps to improve my life. Luckily, I am not alone in my daily struggle and I know that people like me have succeeded. Maybe with time it will become easier. I hope so." [bolding mine]
Lindsay Lohan was sentenced to 4 days in jail on the charges, but the judge ordered the sentence reduced to two days in exchange for 10 days of community service. Lindsay Lohan was given a day credit for time already spent in jail. Therefore, her sentence is:
- 1 day in jail (to be served before January 18)
- 10 days of community service
- attend 18 months of alcohol education program
- attend a drug program
- stay at Cirque Lodge for rehab for an unspecified amount of time
- 3 years of probation
According to the way the ruling works, Lindsay Lohan will spend less than 24 hours in jail. She can enter the jail late at night (before midnight), and leave early the next morning, as that counds as a "day."
Lindsay Lohan’s attorneys met with the LA County Deputy District Attorney today for an hour to enter the please. The District Attorney says that Lindsay Lohan did not receive special consideration as a celebrity.

As I explained above before the law she actually plead (her lawyer entered the plea which is allowed in misdemeanor cases) nolo contedere or no contest. This has the full effect of a guilty plea in terms of criminal law. But, this cannot be used directly in a civil case as an admission and so the plaintiff will have still develop the facts no use the results of the criminal case directly.
On the other had as stated above she stated: “I broke the law, and today I took responsibility by pleading guilty to the charges in my case.” So she is clearly stating that she did wrong.
I happened to buy and watch the “Parent Trap” this afternoon. I also watched the special features. This was Lindsay at the age of 11 who was such a bright and intelligent little girl back then. She is real quite special. She had a complete command of the various techniques of filming and how they were able to show her playing two girls in the same scene.
One wonders why this year she has reached such a crisis in her life. My though is that the on going dirvorce proceedings between her parents might have been the factor that pushed her over the edge. Perhaps subconsciously she was thinking that be getting herself in trouble perhaps it would bring her parents back together to save her. From the tape her father released in which she is saying “Mom still loves you” to him seems to indicate that she wanted them to stay together. So maybe the fact that the divorce is finalized will take some of this stress off of her.

Did she confessed guilty or not? I’m confused. If she did, good then, she admitted she did wrong and didn’t lie. I can’t comment about the justice . Not my jurisdiction, but it’s pleasing she didn’t get heavy sentences. She’s still a child i think who needs serious help. She’s doing ok i guess, i just looked into her myspace(i think it’s hers) which said her mood is calm. I’m glad that this is a good outcome for Lindsay and she has the chance sorting things out and that she really means to do so.
I am delighted with Lindsay Lohan’s statement. She has acknowledged her errors, recognized her problems, and appears ready to do what she needs to do to defeat her addictions.

I am also delighted that her attorney was able to arrange for her to plead nolo contendre rather than guilty. Thus, in any civil action which might be brought, the plaintiffs will have to prove their case and can not rely on the plea in the criminal case. This will discourage frivolous litigation, but not any real and provable claims. Sounds like a just resolution from my vantagepoint.
Better still, the conclusion of this case and Lindsay Lohan’s expressed resolution to turn her life around suggests that before long she will be back giving us fabulous performances on the screen. For a Lindsay Lohan fan, what could be better news than to learn that this brilliant talent is on the mend, overcoming her demons, growing up, and poised for the brilliant return we are all awaiting with anxious glee?

Harry S, it’s kind of hard recognising someone who you’ve only seen in 2D form your whole life, as an actual human being. I mean, some of you guys have been fortunate enough to meet her, so now you can actually envision her without the surrounding movie frame, or the tabloid hype, things which easily distort her identity.
The glitz and glamour that has perpetually surrounded Lindsay, in addition to the way shes been raised under the limelight, has served to make her existence one that has always been rather surreal to me. At times she was nothing more than an image, a voice, an outfit or a pretty face.
But I find the honesty in her statement to be a beautiful and human-like quality. It’s added a new dimension to her character, for me. I imagine that it takes a lot to admit the truth about yourself in a place like L.A.
WHEW! — thanks Deep! It sort of gets complicated in a hurry doesn’t it? OK — so what I follow is that there’s still a lot of unknown/unprovable stuff floating around that may or may not get resolved. It looks like overall that may be helpful from Lindsay’s position in that she can’t get nailed for something she didn’t do — or that can’t be proven.
She still needs to let this be the FINAL LESSON in this chapter of her life.

Feel so sorry for Lindsay. All this is is a result of the media hype and harrasment that follows her everywhere. She is never given one minuites peace, i would go off the rails if everything i did was photgraphed , scrutonised and lied about. What hurts me is that Lindsay is such a talent , with her acting, and her singing , she needs to get back to that.
The constant media frenzy has caused this and i think her parents have to have a good look at themselves, also as for people like Callum best etc drop them all Linz their talentless pathetic semi celebrities who only get noticed when they hang around people like you!

Yeah, to Lindsay’s friend, as I see it the driving charges were included in the plea deal including the July 24 incident. The “nolo plea” as I understand it basically means that she doens’t challenge the charges but doens’t admit to them either. It allows the court to treat her as being guilty and sentence her. On the other had in a civil case related to this the can say that she admits to it as established in the previous criminal case. The plaintiffs will still have prove everything themselves. Because there is pending civil actions this could be important later.
Does this mean that she was driving the driving the Denali? Not necessarily. There were two major objective that the legal defense wanted: 1) avoid any felony drug charges and 2) minimized jail time for the misdemeanors. The DA has to save face and show they were tough so the want guilty pleas to a lot of things. In order to accept the nolo they might have wanted more. Also, she could have got more time that she did for just the May 26 incident which is a lot less controversial … she was likely to have been driving her own car. So she pleads nolo to everything. If she really wasn’t driving the Denali she could still go under oath and deny it in a civil case. At this point we really don’t know. I’ve wondered what video might exist. My guess is that there isn’t any that shows she wasn’t driving or the changes would have been dropped. However, it is lilkey that the three stooges are way overstating their side. It is interesting that they haven’t even filed yet.

Her statement made me so happy. I know its a statement for the press, and such statements often lack both honesty and originality, but her admittance to being an addict seems like such a breakthrough.
All this time it was like she had been dancing around the issue, but now shes just so forthrightedly said it, and it’s probably the most mature thing she’s ever done. It feels like I was tolerating all her past mistakes, and phony trips to rehab, and still maintaining this interest in her as a fan, just so I could hear that statement one day.
She’s finally starting to become a real human being for me.

and
b. “I also note … pleading “nolo contendere” rather than guilty”
Was there a guilty plea? If so, would it be only to charges that were NOT dropped; sounds like the two driving charges were dropped, so a plea of guilty — if there was one — would not apply to any driving charges? If that makes sense?
